It appears that many people who post in 800 notes think the Do Not Call list is a call blocker. Maybe they think reporting a phone number to the DNC people actually blocks those calls to the reporter's phone.

Well, we know that is untrue. However, there IS some confusion about what the DNC does, how it is managed, and if it is intended only for interstate calls (calls between states) or also applies to intrastate calls (calls within the same state). The government itself seems somewhat confused:

The following page states the FCC's DNC Registry applies to both intrastate and interstate telemarketing calls:

However, to confuse things, this page, intended for the business caller (rather than the call recipient) states the DNC Registry applies only to interstate telemarketing calls:

Here is a similar page, again intended for the business caller, that states, "The National Do Not Call Registry covers intrastate telemarketing calls under the FCC’s rules."

So, I looked further, to try to find something written in understandable English, that gave lots of information about the history, objectives and enforcement of the DNC regulations. The following PDF seems to fit the bill.

Here is their definition of "Telemarketing", and where it applies. Hmmm. Still some conflict there, since the word "interstate" is used.

Telemarketing is defined as “a plan, program, or campaign which is conducted to
induce the purchase of goods or services ... by use of one or more
telephones and which involves more than one interstate telephone call


Well, maybe language suitable for Congresspeople is not quite "legal" enough. So, lets look at a legal opinion published in 2004:

The reach of the FCC Rule extends much further. The FCC Rule essentially applies to all entities in the United States, including both persons that are exempt from the FTC Act and persons that are subject to the FTC Rule. Most significantly, the FCC Rule applies to intrastate as well as interstate calls.

Just for grins, today I went to the NDNCR verification page to verify some of my numbers.

The page prompts
1 Enter up to three phone numbers and your email address. Click Submit
2 Check whether the information is correct.
3 Receive an email with the verification information.
So I enter three numbers, etc. It comes back telling me I will receive an email for each number (inefficient, but okay). Sure enough I promptly get three emails.

Email #1 verifies the first number.

Emails #2 & #3 both say
We're sorry. You have exceeded the maximum number of requests to Verify telephone numbers from the National Do Not Call Registry. As a result, we are unable to fulfill your request.
Insert joke about civil servant competency here.

[Would have posted this on 800notes, but it would only start a barrage of "i no the govment sells yer numbers to telamarcketers!! " nonsense. So, nope.]
